Should companies be allowed to official document genes, something which are easily occurring to the human body?

A group of breast cancer patients filed a lawsuit against Myriad Genetics challenging their attempts at gene patenting which enables them to own the only test available to find two particular breast cancer gene mutations.

Should something resembling this be public domain? Thoughts?
Answers:
That's utterly ridiculous. No company has a right to rights naturally occuring human genes, the idea is laughable in My inference.
Very thoughtful and interesting Q.

First -- I am guessing that you meant "congenital" as dead set against "natural occurring?"

Second -- This is the new world. I do not know much about patent, but I am against monopolies.

So, I guess my answer is, "no." Companies be not be allowed to patent genes in this situation -- but I think rightfully they have the right.

Tough question, IMO :)

Absolutely deplorable. They are only doing it to make money. To gain a monopoly for treatment. That is sick
The patent is like a patent on doing research on Antarctica; they discovered it and didn't come up near it.
